Once NASCAR had the auto back from Texas and in its Research and Development Center, the spoiler was removed and determined not to be the part supplied by the vendor.
The rule in question states that spoilers must be used exactly as supplied from the manufacturer and not altered. The infraction was discovered during the usual post-race tear down at NASCAR's Research & Development Center.
"We certainly can't bring the 40-car field back to R&D", Miller said, elaborating on how issues get missed at the track.
Spoilers will be checked at Phoenix this weekend, Miller said, and NASCAR will likely ramp up its penalties next year.
"We're looking at the whole deterrence model and trying to review that over the winter and possibly put more teeth in it", Miller said, per AutoWeek. "It's getting borderline ridiculous".
Harvick was also barred from using the win as an automatic entry into the final four for the November 18 championship race at Homestead. Not only did Harvick lose his spot in the final four at Homestead-Miami Speedway, but he must race the final two weeks of the season without his crew chief and vehicle chief.

Crew chief Rodney Childers has been fined $75,000 and suspended for the remaining races at Phoenix and Homestead.
Harvick was docked 40 driver points, and Stewart-Haas Racing was docked 40 owner points as well. With the reduction, Harvick falls to fourth in the standings and may not use his Texas win as a tiebreaker should such a situation arise.
SHR will not appeal the penalties.
Zipadelli said Tony Gibson will serve as interim crew chief and Nick DeFazio will be interim auto chief.
Stewart-Haas Racing will not appeal the penalty. "Instead, we will direct our immediate focus to this weekend's event in Phoenix and control our destiny on the racetrack".
Harvick's win at Texas was his series-leading eighth in 2018.
ISM Raceway in Phoenix represents Harvick's best chance to get a win that would guarantee his spot in the championship race. The team has not made any members available for comment, and Harvick is not scheduled to speak to the media at Phoenix, where he is a nine-time victor. This probably won't be an issue considering the fact that he has nine career victories at the track, including one earlier this season in March. Kurt Busch is the final combatant, as he sits just three points behind Harvick.
The penalty is disastrous for SHR, which went into the third round of the playoffs with all four of its drivers eligible for the championship.
